Marianne focuses her practice in litigation issues
in the areas of construction, banking, insurance, and complex commercial
litigation. She represents owners and developers, contractors,
subcontractors and material suppliers, as well as colleges and
universities, banking institutions, local government, manufacturers and insurance
companies in a wide range of litigation matters. She is board-certified
by the National Board of Trial Advocacy as a civil trial advocate.
Marianne counsels clients regarding risk avoidance
and manages construction litigation and dispute resolution proceedings,
including mechanics lien claims.
In a recent case, Marianne obtained a partial
summary judgment for a bank on whether the owner of a bank account can
assert claims of conversion against a bank that allows third parties to
deplete the account of funds through acts of forgery that are not known
to the account owner — an
issue never before decided by Pennsylvania state appellate courts.
Marianne was successful in obtaining summary judgment for a bank in a
similar case also involving the Uniform Commercial Code. She has also
successfully tried cases involving claims under Pennsylvania’s
Whistleblower Act and the Commonwealth’s Wage Payment and Collection
Law.
