Sue concentrates her
practice in complex commercial litigation and dispute resolution,
counseling clients in the pharmaceutical, manufacturing, construction,
insurance and healthcare industries, with a particular emphasis on
construction and antitrust matters.
She has represented
owners including pharmaceutical manufacturers, research universities,
real estate developers and homeowners in connection with construction
delay and defect claims; manufacturers in distributor termination cases;
and insurers in breach of contract and breach of statutory duty claims
brought by state regulators and agencies.
Sue also devotes a
substantial part of her practice to representing owners in negotiating
and drafting agreements of all types relating to construction projects,
including construction management agreements, design-build agreements
and agreements with design professionals. She is familiar with the AIA
forms of construction contract documents and the forms published by the
AGC and the EJCDC and has provided many owner clients with advice
concerning modification of form agreements to satisfy the owner’s
particular needs.
In addition, she has
significant experience preparing owner-specific agreements. For example,
she recently assisted a regional bank in developing master agreements
and project-specific agreements with preferred design services providers
and preferred general contractors. She presently represents a
pharmaceutical company in connection with a new manufacturing facility
with the negotiation and drafting of the Project Specific Agreement with
the design professionals, the Construction Management Agreement, the
validation services agreement, the design-build agreement for a
waste-water pretreatment plant and all of the agreements for
owner-supplied equipment.
Sue has also handled
multiple matters raising claims under state and federal antitrust and
unfair competition laws, including claims arising under the Sherman Act,
Robinson-Patman Act, Clayton Act and Lanham Act.
Since 1997, Sue has
served as a mediation neutral in assisting parties in more than 100
matters to resolve disputes outside of the litigation process. She has
received certificates from the National Institute for Trial Advocacy and
the Center for Mediation in Law and currently serves as a mediator on
the roster of mediators for court-annexed mediation in New Jersey. She
was named 2005 “ADR Practitioner of the Year” by the New Jersey State
Bar Association for her contributions to advance the cause of mediation
and other forms of alternative dispute resolution in New Jersey.
Sue was a law clerk to The Honorable Warren W. Eginton, U.S. District
Court, District of Connecticut.
