courts in New Jersey and New York, where he has represented numerous clients in a
wide variety of complex commercial, employment and insurance coverage
actions. As part of his litigation practice, Brad handles business and
contract disputes, license agreement disputes and product liability,
design patent and trademark infringement claims. He also counsels
corporations on pre-litigation and business development
strategies.
Mr. Mitchell regularly represents employers in all
phases of employment-related litigation arising under federal, state and
local employment laws, as well as in common law claims. He represents
clients before state and federal trial and appellate courts and before
the EEOC and various state and local EEO agencies. His representative
cases include claims for sexual harassment, wrongful termination,
discrimination, violation of whistleblower laws, wage and hour
violations, misappropriation of trade secrets and violations of
non-competition agreements.
In addition to actively litigating disputes, Mr.
Mitchell also provides counsel to employers in all aspects of employment
law, including employer relations, employment discrimination, wrongful
discharge, employment and severance agreements and preparation of
employment policies, practices and handbooks, among others. He advises
employers regarding issues under Title VII, ADEA, ADA, FLSA, FMLA and
WARN, as well as all aspects of New Jersey state law governing labor and
employment.
