Brandon S. Shemtob, Shareholder and member of the firm’s Labor and Employment Group, will present “Employment/Labor Update — Cemex and Beyond” at The In-House Lawyer All Day CLE Program hosted by the Association of Corporate Counsels’ (ACC) Central PA Chapter in Marietta, PA, on Wednesday, Oct. 2, 2024.
Brandon will cover the NLRB’s historic and paradigm-shifting decisions and rules affecting many organizations. Of critical importance, the NLRB dramatically changed the process of how a union can be formed in the workplace. Instead of the union being required to file for an election with the NLRB, the union can now simply demand an employer recognize and bargain with the union if the union is able to collect a majority of union authorization cards from an appropriate unit of employees. If this occurs, the onus shifts to the employer to file for an election to test the union’s claim. Importantly, however, if an employer violates federal law during the campaign period the NLRB will immediately cancel the election and issue a bargaining order which will treat the employees as “unionized” and require the company to begin to bargain with the union.
Brandon will also address the profound effects these changes will have on non-union employers who may have little to no experience in labor law. It is important that employers learn how this process works and what to do if confronted by a unionization drive.
This full day conference will give attendees the opportunity to earn 6 hours of CLE credit, including 5 hours substantive and 1 hour ethics.
