Representation of Insureds

Our insurance lawyers have successfully counseled insureds on coverage disputes with their carriers and have resolved those disputes on their behalf.  As a result, we bring a wealth of experience to your insurance issues and can assist you in all aspects of the insurance recovery process:

  • Reviewing policies and facts surrounding losses;
  • Advising on claim presentation;
  • Advising on securing forensic accounting and other expert assistance;
  • Assuring compliance with statutory and policy deadlines and obligations;
  • Negotiation of partial payments;
  • Documentary and witness support for claimed losses; and
  • Negotiating, mediating, arbitrating or litigating the claim as necessary to perfect recovery for our clients.

We also frequently advise our clients about coverage on both liability and first-party policies.

Because of our substantial banking and financial services litigation practice and the cottage industry that has developed in recent years in which, after a merger is announced, a dissident shareholder sues the members of the board of directors, our lawyers, led by Stacey A. Scrivani, have developed a specialty practice in Directors’ and Officers’ Liability Litigation and frequently advise clients about their D&O insurance coverage.

Representation of Insurance Carriers

Our experienced insurance litigators, led by E. Thomas Henefer, have represented insurance companies in a wide range of insurance litigation matters, including bad faith claims, first-party life, health, and disability disputes, and fraud-rescission matters in state and federal courts.  We also have extensive experience representing insurance companies in commercial disputes including market conduct and product “suitability” disputes, and have assisted our clients in internal investigations of fraudulent conduct by agents and/or customers.

One of our Bankruptcy lawyers, Leonard P. Goldberger, has extensive experience representing insurers in connection with asbestos, mass tort environmental and product liability bankruptcy cases. A former Vice President, Director and Executive Committee member of the American Bankruptcy Institute, Lenny has also been Chair of the American Bar Association’s Committee on Insurance Coverage Subcommittee on Insolvency and is a member of the ABA’s Litigation Section and its Tort Trial and Insurance Practice Section.  For the last 12 years, Lenny has given programs on insurance and policyholder bankruptcies at the Insurance Society of Philadelphia.
