Stevens & Lee’s Labor and IP Team Lead Notable Union Trademark Infringement Case

Highly publicized shortly after the case filing on October 13, firm client Medieval Times, a family dinner theater featuring staged medieval-style games, has accused the union Medieval Times Performers United of trademark infringement for using the company’s name, branding and logo stylings on its website – a move that could confuse customers with a false affiliation.

Mark H. Anania and Daniel J. Sobol represent Medieval Times in this suit that seeks to address the company’s loss of control of how its IP is used when a union adopts the branding of the company they are trying to organize. The arguments and outcome of this case hold particular significance as high-profile unionization campaigns like Starbucks Workers United and the Amazon Labor Union maintain organizing efforts that bear company names.
