Richard is Co-Chair of the Health Care Department and concentrates his practice in health law, with emphasis on federal and state regulatory compliance, corporate governance and third party reimbursement, including Medicare, Medicaid and non-governmental commercial payers. He also represents health care providers in litigation matters in federal and state courts and before the Provider Reimbursement Review Board, Federal Administrative Law Judges and state administrative agencies.

Richard has represented more than 100 nursing homes, hospitals and personal care facilities in state and regulatory proceedings, including survey, certification and certificate of need matters. He has appealed Medicaid and Medicare disputes in which additional reimbursement for hospital and nursing home clients was obtained and has defended clients in insurance, health care, commercial and franchise law matters.

Richard’s health care transactional experience includes negotiating and structuring hospital and post-acute care mergers, acquisitions, and affiliations, medical practice mergers and acquisitions, and negotiating and drafting managed care contracts.  Additionally, Richard regularly counsels clients regarding compliance with federal and state laws, including the Anti-Kickback Statute, HIPAA and the physician self-referral prohibitions (Stark Law).

Prior to re-entering private practice, Richard was Vice President, Managed Care Contracting and Associate General Counsel at Lancaster General, a nonprofit, multi-hospital health system in Lancaster, Pennsylvania. In this position he was responsible for corporate compliance, preparing, negotiating and executing employment and service agreements and managing corporate transactional documents and organizational affairs.

Richard frequently writes and speaks on a wide range of health law and policy topics and has given presentations for professional organizations, including the American Health Lawyers Association, Pennsylvania Bar Institute and Health Care Financial Management Association.
