Pennsylvania is a property rights state, which is to say that government regulation is only valid if it is statutorily authorized, and is constitutionally clear and even handed. In the last half century, the public’s expectations of government have changed, so both the legislature and the courts have been more deferential to regulation that seeks to restrict property rights.
Property owners and developers have had various means of recourse, but over time, most of those protections have disappeared, leaving property right holders subject to arbitrary governmental behavior.
Our brief seminar will explore the various means of recourse, and their current availability in this pro-regulatory environment. We will conclude with a real time case study that suggests a new line of protection not previously used in Pennsylvania when regulatory overreach is most egregious.
