Product Liability

Our team has defended manufacturers or suppliers of a range of consumer and industrial products, against major product liability claims arising from brain damage, cancers and other profound injuries. We represent clients in regard to regulatory issues under the jurisdiction of the U.S. Consumer Product Safety Commission (CPSC), the Food and Drug Administration (FDA) and their state counterparts, and other regulatory agencies. We have handled multi-million dollar chemical contamination related-environmental property damage and equipment contamination claims.

Outside of court, we frequently counsel clients on regulatory, labeling, packaging and marketing issues to help manage risk and avoid litigation. We further advise clients on product safety compliance, reporting, and recalls, and assist them in the development of policies and procedures to coordinate and facilitate national handling of product liability issues and claims. Finally, we assess clients’ self-insurance programs or other insurance coverage to minimize the potential for litigation.

Toxic Torts

Our lawyers regularly defend chemical and industrial product manufacturers and suppliers against personal injury claims involving various materials such as asbestos, mold, lead and chemical compounds such as cutting oils, paints, fuels, solvents, benzene, and vinyl chloride. We have substantial expertise handling complex litigation involving lead, asbestos, mold, and PCBs.

We have served as National Coordinating Counsel and coverage counsel for multiple companies named in asbestos personal injury and wrongful death cases in multiple jurisdictions.

We have also successfully resolved toxic tort issues by working with many of the country’s largest insurers and their clients. We regularly represent clients in federal and state courts in Pennsylvania, New Jersey and Delaware. We are mindful always of the need for clear and open communication among the insurer, the insured and their counsel, and use that level of communication to maximize our effectiveness in obtaining the best results in the litigation we undertake for our clients.

In addition, our toxic tort lawyers partner with our bankruptcy lawyers to litigate high stakes insurance-related issues in mass tort and products liability bankruptcy cases.
