Real Estate Litigation

We represent both public and private sector clients in matters involving land use planning laws, disposition and development agreements, and denials and approvals of land use entitlements, including zoning amendments, exactions and conditional-use permits. We also represent clients, including the Pennsylvania Turnpike, in eminent domain and inverse condemnation matters. For over a dozen years, one of our real estate litigators, Mark D. Bradshaw, has handled trial and appellate work in the eminent domain field, which has resulted in numerous appeals, some of which have been the subject of repeated appeals to the Commonwealth Court and the Pennsylvania Supreme Court.

Our experience extends to various areas of real estate litigation, including:

  • Eminent domain
  • Ownership disputes
  • Breach of lease/lease options
  • Easement and boundary disputes
  • Foreclosure/deficiency judgments
  • Challenges to land development denials and inappropriate conditions of approvals
  • Zoning appeals, including exclusionary zoning challenges
  • Buy-sell agreements
  • Right of first refusal
  • Performance disputes
  • Tax appeals
  • Fraudulent nondisclosure of environmental contamination
